Terms of Use

Welcome to Thumb-of-War. These Terms of Use ("Terms") govern your download, installation, and use of the Thumb-of-War mobile application (the "Game") provided by Thumb-of-War Studio ("we", "us", or "our").

By downloading, installing, or using the Game, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the Game.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use one copy of the Game on a mobile device that you own or control, solely for your personal, non-commercial entertainment purposes.

You may not: (a) modify, translate, adapt, or create derivative works of the Game; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game; (c) rent, lease, lend, sell, redistribute, or sublicense the Game; or (d) copy the Game (other than as expressly permitted by this license).

2. User Content & Local Play

Thumb-of-War is a local-only multiplayer game. All profiles, local progression, custom skins, and high scores are stored locally on your device. We do not maintain accounts or store player data on servers. You are solely responsible for protecting and maintaining your device and any local game progress. We are not responsible for lost scores, reset settings, or data loss due to app deletion, OS updates, or device replacement.

3. Intellectual Property Rights

All intellectual property rights in and to the Game, including but not limited to graphics, user interfaces, branding logos, characters, skins, code, audio, and visual assets, are owned by Thumb-of-War Studio and its licensors. The Game is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

4. Prohibited Conduct

You agree not to use the Game in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Game, or that could damage, disable, overburden, or impair the functioning of the Game in any manner. You agree not to attempt to cheat, exploit bugs, or manipulate local scores in public forums or leaderboards.

5. Disclaimer of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THUMB-OF-WAR STUDIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL RUN UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE GAME IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THUMB-OF-WAR STUDIO, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE GAME, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Specifically, since the Game involves high-intensity button mashing and physical reflex trials, we are not responsible for any physical damage to your mobile device (e.g., screen damage due to heavy mashing force) or any personal injury arising from competitive gameplay interactions.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make updates, we will revise the "Last Updated" date at the top of these Terms. By continuing to access or use our Game after those revisions become effective, you agree to be bound by the revised Terms.
